A New York state appeals court held that New York municipalities can use local zoning laws to ban the use of hydraulic fracturing in oil and gas drilling.  The court held that the applicable New York state law does not preempt a local government's authority to control land use within its boundaries. The case will be appealed to the state's highest court.  There are similar challenges across the nation, including pending litigation in Colorado.
