Denver based SM Energy pled guilty to three counts of unlawful taking under the Migratory Bird Act after migratory birds were found dead in a number of their oil field ponds.  In addition to the fines assessed as part of the plea, SM Energy is on one-year probation and must adopt a new enforcement compliance plan to prevent more deaths in the future.
